Terms of Service for Lovelace Photo Co.

Welcome to Lovelace Photo Co. By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions.
1. Services
Lovelace Photo Co. provides wedding photography services, including engagement, proposal, elopement, and family sessions. Detailed information about our services can be found on our website.
2. Booking and Payments
- All bookings require a 25% deposit to secure your date unless otherwise stated in the contract.
- The deposit is non-refundable, except under specific conditions outlined below.
- Final payment for all weddings is due 7 days prior to the event. Clients may choose to pay in installments leading up to the event.
- If a client books a wedding package with an included engagement session and is not satisfied with the engagement photos, a full refund will be provided, and the contract will be dissolved, provided the cancellation and refund are requested within two weeks of the engagement photos being delivered. This policy is not available after the final payment is made or the booked wedding date has passed, whichever comes sooner.
3. Cancellations and Refunds
- Cancellations must be made in writing. Deposits are non-refundable.
- If the Photographer secures another engagement for the same date, any payments made will be retained as liquidated damages relative to the new engagement value.
- Full refund policy applies to unsatisfactory engagement sessions as stated above, within the specified timeframe.
4. Contract Outline
Cancellation: Once the Client signs this agreement, the Photographer will reserve the wedding date. If the Client cancels the Photographer’s services, the Photographer will retain any payments made. The Photographer will attempt to secure a replacement engagement for the wedding date and will retain any deficiency in the value of the new engagement relative to this agreement.
Specific Shots: The Photographer does not guarantee any specific photograph or shot. Clients should provide a list of desired photographs at least one week before the wedding date.
Permits: Clients are responsible for obtaining all necessary permits and passes for photographic access.
Meals: Clients will provide the Photographer (and assistant) with a full meal on the wedding day.
Exclusivity: The Photographer is the exclusive still photographer hired by the Client for the wedding events.
Liability Limits: The Photographer’s liability is limited to the payments made under this agreement.
Replacement Photographer: The Photographer may substitute another competent professional in case of illness or emergency.
Selection of Photographs: The Photographer will select and provide digital copies of the best photographs. Post-production editing is at the Photographer’s discretion unless otherwise agreed in writing.
Retention of Photographs: The Photographer will retain copies of the photographs for at least 12 months after the wedding date.
Ownership & Copyright: The Photographer owns all rights, including copyrights, to the photographs.
Client’s Use of Photographs: Clients may use the photographs for personal, non-commercial purposes, with proper credit to the Photographer when customary. Commercial use or editing without consent is prohibited.
Model Release: Clients grant the Photographer unrestricted, perpetual, and irrevocable permission to use the photographs for any legal purpose worldwide.
Choice of Law and Arbitration: California law governs this agreement. Disputes will be resolved by arbitration in California by the American Arbitration Association. Small claims can be asserted in Los Angeles, CA.
Miscellaneous: This agreement is the final, exclusive, and complete understanding regarding the Photographer’s services. Modifications must be in writing. Invalid provisions do not affect the agreement’s validity. A party’s failure to enforce a provision does not waive that provision.
5. Delivery of Photos
Photos are delivered via an online gallery (Pixieset). Clients can provide their own flash drives or SSD drives for no additional charge. Delivery times vary per contract.
